it is friday january 25th. welcome. i'm brian flores. >> i'm pam cook. time is 7:00. topping the news, a kidnapping attempt near a school has parents and students on edge. we are outside sutter elementary where a man reportedly tried to lure a young boy. >> reporter: we have been talking to parents in this neighborhood all morning as they get ready for work and get their kids ready for school. everybody we talk to is just now hearing about this attempted kidnapping of a 5th grade student here at sutter elementary in antioch. >> this is absolutely shocking. my son was right across the street. >> reporter: did you get a note home? sent from the school? >> no. i didn't get anything sent home unless somebody called and we didn't get the call. >> reporter: so what are your concern now as you drop your kid off? >> am i going to let him go to school? >> reporter: and after we

talked to him he went across the street to the house where his son lives and said he was going to give him a refresher about stranger danger and talk to his mom about if they would send him. the boy's mother in the attempted kidnapping called the school to report a man tried to get her son into his car by telling the boy that a family member had sent him to pick the boy up. the boy told the man hey i don't know you and then walked away. that suspect was last seen in the park, that's -- a park that is just behind the school with in walking distance. you can see the school from the park. the suspect was sitting in his car in that car -- in that parking lot behind the school. we do have a suspect description. he is a white man with gray hair and facial stubble. he was driving a light blue 70s era car.

last seen? the area of sutter elementary school and the park which is behind the school. this is a good lesson and time for parents to refresh kids about stranger danger, let them know if anyone they don't know approaches them to -- at the very least walk away but also yell and walk away. reporting live in antioch. >> thank you. new this moing the taliban is claiming responsibility for a botched suicide car bombing in afghanistan. that was supposed to target nato troops. the car bomber was trying to hit a convoy. instead he rammed into two houses killing five civilians and hurting another 25 people. in the united states military will not lower it's physical standards as it opens direct combat jobs for women. it announces the change in policy yesterday. the goal is to ensure the mission is met with the best qualified and most capable

regardless of gender. about an hour from now the vice president will host a round table on gun violence in richmond virginia. he and other administration officials will hear from experts who woked on gun safety after the 2007 shooting at virginia tech and coming up at 7:15 the one group the obama administration is targeting in its efforting ono gun control. >> a hearing is scheduled in san francisco this morning in connection to the murder of a suspected pimp. there are four defendants in the case. prosecutors are consolidating the four cases in to one. a 22-year-old calvin snead was killed last june. it's believed the defendants were trying to protect a 17- year-old girl suspected of prostitution. it would have the defendants are her parents. sentencing scheduled for a teen accused of killing a couple who adopted him. he pled guilty to choking them to death in a fit of rage. he had been suspended for

smoking marijuana. his lawyer had argued that he suffer from a disorder that affects kid whose are adopted. the san jose fire department said its reported response times are likely wrong because of a data collection error. the fire department's response time goal is for firefighters to arrive with in eight minutes of a call 80% of the time. a computer error means that the department may have missed its response time goals more often than first reported. the president of the san jose firefighters union said the city needs to disclose the true response times and the firefighters union believes response teams have been increasing because of reduce staffing. >> let the countdown start. the big game is just nine days away and city leaders are considering some tough measures to keep 49er fans in line during the super bowl. paul chambers joins us live from san francisco with a message that's going out to city bars. >> reporter: good morning. i will say before we get to that there is a plan a lot of people want to do, come out

here like they did during the giant's world series. that can't happen because the nfl won't allow a public viewing party. now that will not stop a lot of niner fans celebrating of course. this was a scene last week when fans took to the streets in an effort of keeping the city and people safe. the mayor is asking that places serving hard alcohol be more responsible. >> to suggest that they serve something that heavy alcohol during the time the celebration, being drunk sometimes doesn't help. >> reporter: the next week the mayor and police chief will visit areas hit by vandals after the giants won and discuss the plan for safety on super bowl sunday which includes up to 500 officers on the streets, three times the amount of a normal sunday. fire marshalls will also hit the streets. >> if it look like its getting out of hand or they have had to much of a crowd in the bar we will close it. >> reporter: no need to stock up on alcohol. the office wants to stress it's

southbound. a bad spot at 237. i will put it onto map. southbound 880 at 237. this crash is blocking at least one lane. they are moving it to the shoulder but it could make traffic pretty slow in the area. northbound 880 -- there was word there could have been another crash as well. they are checking it out. as we move the maps over to haywood, union city and fremont this drive looks good heading south. out to the live pictures the east shore freeway, that traffic does look good heading west out toward the mcarthur maze. at the toll plaza we have, about a five minute delay. in you are using the carpool lane make that maybe one or zero minutes because it's pretty light today for a friday where i think we are getting a friday light commute. >> thank you. very good morning. mostly cloudy skies, little bit of a light rain but right now just a lot of clouds and fog.

so visibility, probably lousy for few areas until about nine and then things should improve. in between systems, one to the south which gave us that rain. even a little bit of rain onto northern edge but most looks like its moving out of the picture. system to the north which is driving it south. 50s on the temperature, upper 40s. very mild, all this cloud cover and moisture. that's letting that fog form. probably above lake level and the system to the north up there will keep cloud cover in the forecast so patchy fog, mostly cloudy, kind of mild and plugy. lot of rain -- any travel plans today or saturday. you may want to watch the sun. not much of a difference on these temperatures. everybody, 61, 62 should cover it. weekend always in view a colder system. not again. not that bad.

this is new video taken moments ago where a huge crowd is gathered. officers fired tear gas on the protesters earlier trying to break it up. protesters are not happy with the current president and accuse him and the muslim brotherhood of forming a new dictatorship. >> here is live -- we will go to live pictures right now -- okay, we will move on. just about 45 minutes from now the vice president starts a series of nationwide trips to push for gun safety. we are in the washington dc newsroom with more on what biden's focus is. >> reporter: yeah . the vice president is pushing for background checks and a limit on high capacity magazines. those are just a couple of the proposals coming out of the white house. they plan on several nationwide stops in the coming weeks.

they are no longer focusing on winning over supporters on capitol hill but will look at those in states. the department of justice told me assault weapons use in less than 8% of murders and violent crime but biden said taking them out of the picture will help. >> police organizations overwhelmingly support it because they get out gunned. they are out gunned on the streets. >> reporter: his round table discussion gets started in about 45 minutes in richmond virginia but his efforts are riling up republicans. what they are saying when i see you next. >> all right. thank you. the wait for answers around the deadly elementary school shooting in newtown got longer. a state prosecutor said they won't have their report ready until june at the earliest. last month a gunman opened fire killing 20 children and six adults. the shooting is still under investigation. >> a teen student tazed by

police at a cool is demanding to know why. the 14-year-old ivan garcia and his parents are questioning the use of force. he still has a bruise on his stomach more than a week later. this picture was taken before it was removed. a police stunned him as he and another student were fighting at highland high school. >> i feel a really bad pain, like a bad pain and all i do is fall to the ground. i fall to the ground on my face and then i was on the ground and i couldn't move and i hear him say if you move again i will taze you again. >> reporter: the school district that oversees the police department is not commenting about the incident. garcia said he was suspended for a week and he will now be home schooled for the rest of the school year. his family is looking into some legal options. police have arrested a middle school student in morgan hill on charges of bullying other students. coming up, we will have a live report from the south bay and

what police are saying about the teen suspect in this case. >> with marijuana smoking now level in colorado the state could soon set new regulations on how stoned drivers can get. experts are worried that the state will see a large jump in the number of accidents involving drivers under the influence of marijuana. in 2011, 13% of deadly crashes in colorado involved pot. lawmakers proposing the limit at 5nanograms of thc. a retired fire captain is a accused of stealing gear from fire stations. he faces grand theft and burglar charges. investigators recovered 268 stolen items including uniforms, tools and other supplies. they say he also had a large cache of illegal weapons. he retired just before getting arrested. it looks like senior official was the state parks department have dodged a big bullet. the da has announced charges won't be field after

allegations they hid millions of dollars in state funds. it came as the state threatened to close 70 parks because of cuts but the da said it would be hard to prove any criminal wrongdoing. >> a pleasanton city employee is in jail after allegedly enrolling his children in a rec program without paying for it. police say that the supervisor ian marshall anderson used the city database to get around the system. it would have cost $300. he faces charges of embezzlement. you should know that later tonight one of the runways at san francisco international airport will be temporarily closed for construction. that means this weekend sfo will only be able to handle about half the usual 60 flights an hour because of that. travelers are told to check before heading to the airport for delays. the runway will reopen at 8:00 monday morning. >> you are probably just make

let's go to sal with traffic. sal how does it look? >> there is new crash -- it's kind of a change of the old crash. southbound 880, we had at 237. they found at dixon and they have issued a sig alert saying lanes are blocked. watch for delays. you want to see what this will do to the traffic time. it is still about 18 minutes. we will watch that because if that crash ends up being there for a while this could spike way up, a couple days ago we had almost an hour along this drive time stretch. let's go into take a look at the live pictures. 280 northbound, downtown san jose that traffic is busy. we have a live picture but maybe getting blocked by some of the weather. i don't know if we have that picture. there it is. kind of -- i don't know the weather is moving in, the traffic is light but looks like

it could be raining or drizzling. at the toll plaza it's a light delay. let's go to steve. >> lot of fog out there and temperatures 40s and low 50s. looks like a little bit of a break here. we are in between systems. there are breaks, the system responsible for the clouds and rain is in southern california. there is another one in the north, to the north which is pushing it out of the area. still a lot of low level clouds, very thick fog from santa rosa, east bay down to san jose as you saw looks to be getting thicker down toward the south bay. upper 40s, low 50s and temperatures, won't take long to recover but i don't think we will get that much sun. look at -- i will show you a close up. maybe people have travel plans but some has been spinning up to the south bay. 60s on the temperatures, everybody 60 to 62 should cover t i don't think much of a difference. with the weekend always in view

. good morning. westbound 237, i'm sorry southbound 880 approaching 237, there is a crash at dixon landing road. at least a couple of lanes blocked and photograph sick quickly starting to back up through this area as you drive south. you may want to think about using 680 if you can use another route instead of 880 driving toward san jose. this is 237 nearby. you can tell the roads are wet. not really great driving conditions. i don't think a lot of people are making it through because it's lighter than usual but there is an accident just up the road >> police have arrested a middle school student who is a ceus of bullying two other students. that happened at britton middle and reportedly continued online. we have what we learned about this case. >> reporter: police say this

bullying was going on for months. the two boys were being pressured to use marijuana and when they said no that's when the problem started. a 14-year-old at the school threatened his two classmates who were 13, verbally and physically. officers say the 14-year-old shot a bb gun at them, the harassment was taking place at school and at home. a resource officer warned the suspecbut later this day police say he threatened one of the victims at a skate park and followed with texts to their cell phones and postings on facebook. the 14-year-old was cited for battery, harassing phone calls, disturbing the piece and discharging a soft air weapon. he also faces action by the school district. they say it highlights the strong stance on bullying how they won't tolerate it. just moments ago i spoke with the principal here at the school and coming up at 8:30 you will hear what he has to

say. reporting live from morgan hill. >> a high school student was taken to the hospital after an argument got worse over the internet. the principal at freedom high told the times that two girls bumped into each other in the hallway on wednesday. they later exchanged angry online posts. one of the girls then supposedly attacked the other in the school yesterday. the victim fell and hit her head. we don't know the extent of her injuries but the principal will urge students not to air disputes through facebook. police septembering a homicide, the second in two days. the latest happened last night near south side drive and hope street in south san jose. a group of men walked up to the victim and stabbed him. investigators have yet to find a motive. this morning we talked to a neighbor who is worried that it'll lead to more violence. >> just all talking and we couldn't believe how this is a quiet neighborhood and something like that would be

just right up the street. >> police aren't sure if it's connected but they are looking for a gray van that left the scene right after the attack. >> we are learning a suspect in the hostage situation in sacramento was wanted for questioning in a burglary here in the bay area. police say the 49-year-old held a woman against her will for several hours in a home in downtown sacramento on wednesday. the woman eventually ran from the home and was not hurt. police later arrested the man. they later learned he had a warrant for burglary. san francisco police are warning members of the china community about a scam targeting older victims. they want everybody to take a close look at a surrender vail video. it shows three people targeting a victim. police say they trick people into seeing a doctor who will bless their valuables. they are then put in a bag. the conartists then switch out

their work hours were cut during the lock out. the sharks scored four goals in the third period to beat the coyotes. people who work at restaurants in san francisco could get another payday. more than 50 restaurant owners are being targeted for charging extra fees to cover the city mandated health care coverage. the city claims only a third of that money actually went to medical costs. today san francisco city attorney plans to announce a program that would require restaurants and a handful of other business to pay back a portion of that money to employees. >> san francisco's muni may ask voters for more money to fund major transportation improvements. in 2008 they started the first review of its operations in years. recommendations coming out of that review include several initiatives to speed up the public transit system. they estimate it would cost $175 million. one idea under discussion is asking voters to approve a bond to fund the project but muni

southern california. there is one to the south. the one in the north has pushed this system out so the rain will end for us but look at that moisture. keep that in mind. the moisture left behind also means mild temperatures. 40s and 50s. there is really mild air in place. kind of muggy, especially with a little bit of sun and a few breaks. only low clouds mainly, higher up here kind of filter in toward the north bay as that next system slides in, patchy fog, mostly cloudy, partly sunny in the afternoon. there is a little bit of drizzle and a lot of fog. clouds and sun very mild. light rain to the south. maybe santa clara but maybe just more drizzle. low 60s on these temperatures, almost everybody but, with the weekend there, saturday looks okay and then one system out of the north sunday looks like it'll stay north and east but it'll bring back in cooler air. the lows will be cool. >> thank you. rushing waters are causing

dangerous conditions in australia. five-days of heavy rain there left several parts of the country under water. it's all because the remains of the once tropical cyclone oswald. it's gaining strength again. roads have been shut down and authorities are preparing for the worst. we are bringing you a firsthand look at your tax dollars at work in the tunnel. we got a look inside the 4th bore yesterday. we found crews hard at work inside. federal stimulus funds are paying for two thirds of the 400 million-dollar project. taxpayers are funding the rest. >> when it's done caltrans will be dedicating two bores permanently to eastbound traffic and two permanently to westbound traffic. >> caltrans said the 4th is 75 to 80% done. they will start laying the road bed next month and it's set to open later this year.

estimates. p and g better than expected and starbucks. sales of new single family homes fell. numbers dropped to a yearly rate of 369,000. that's down 7.3% from november but sales still up nearly 9% from december of 2011 and prices continue to rise slowly. in the last week united states mortgage rates went up slightly but remain near their record lows. the average 30 year fixed loan slightly more than 3.4%. that's up about one tenth of a percent. >> we are following big news involving the search engine giant in mountain view. google reports that the united states government's request for information has skyrocketed in recent months. we are live to explain what it means. >> reporter: good morning. you know this is all based on this report that goal just

released. it says that the government more subpoena more is asking for users data and they are accessing it without a warrant. what a warrant would usually do is a judge would have to agree that the information being requested, the investigators have probable cause to request that information. instead we are finding that authorities are relying on a mostly 1986 statute that lets them use a subpoena which only requires them to state that the information is relevant in an investigation. that's all they need and that is something widely criticized. the data requests can include anything, local company. google as gotten more than 22,000 requests for data in the last six months of the year. those requests were for information about more than 33,000 users. now in general these requests

are usually from investigators looking to collect evidence in criminal cases. google said there were somewhere they weren't sure why the information was being requested and in some of those instances google rejected the requests. back to you. >> all right. thank you. the investigation into the boeing dream liner is far from complete. the chair of the ntsb said investigators have found what she called symptoms in the battery fire of a jet in boston but she adds they have not yet found the cause of the problem. she calls the problems an unprecedented event. its been grounded around the world since last week. a new strain of nora virus is spreading in the united states. the cdc said that the virus strain has caused 140 outbreaks here. the strain has already hit japan and western europe. symptoms include vomiting and

diarrhea. huge flames a building fire in mass but it was the freezing conditions that proved more challenging for firefighters. spray from fire hoses formed ice and made for slippery conditions on the ground. ice formed on helmets and jackets while they knocked down the flames. the cause of the fire is still under investigation. >> the senate is set to vote monday on a 50 billion-dollar emergency relief bill to help victims of sandy. lawmakers new york, new jersey and connecticut say it's urgently needed. sandy hit the east coast last october killing 140 people and destroying homes and businesses. the house passed the emergency relief bill last week. storm victims in new jersey will have to meet new standard when's they rebuild their homes because for the first time in 20 years the federal emergency management agency has updated the flood maps for the jersey shore. that is now a higher risk zone. new jersey governor said that

property owners will see a benefit. >> you will see lower insurance costs in the long run. if if run. if you don't meet new stand standards you will be less safe. >> it was the sound of cheering for gay couples in rhode island late last night. the house passed legislation that would allow same sex couples to get married. it's not official just yet. it must go through the senate. right now rhode island is the only state in new england that doesn't allow same sex couples to get marry. the founder of facebook wants to help a friend keep his job as governor. they are hosting a fundraiser for the governor of new jersey. he met the governor when he donated $100 million to public schools in newark new jersey.

strong stance. police say two 13-year-old's were being pressured by a 14- year-old classmate to smoke marijuana. when they said no that's when they were verbally and physical harassed and bullied. the school resource officer spoke to the boys at the school and wand the suspects but later this day the suspect threatened one of them after school at a community skate park and followed up with texts and postings on facebook. the principal reacted this morning. >> disappointed. it's the kind of thing that happens time to time and i think what -- is really important here to take away from this is that students are going to be responsible for their actions. >> reporter: investigators side the 14-year-old for battery, making harassing phone calls and discharging a soft air weapon. police say that's because at some point during the incident

partly sunny, partly cloudy, sunday colder and then next week looking dry but the lows will be back down in the 30s. >> thank you. san jose police are look for a group of men responsible for a deadly stabbing. it happened around 8:30 last night near south side drive and hope street. the suspects approached the victim and stabbed him several times. investigators don't have a motive for the attack. they are trying to identity the male victim as he didn't have identification on him. a short time ago we talked to a neighbor who is worried that will lead to more violence in the area. >> very unsettling because this is a -- really quiet street, it's a nice neighborhood. i know we lost a lot of sleep. >> this was san jose's third homicide of the year and the second in straight days. >> we are learning a suspect in a hostage situation in sacramento was wanted for questioning in a burglary here in the bay area. police say that the 49-year-old

held a woman against her will for several hours in a home in downtown sacramento on wednesday. the woman eventually ran from the home and was not hurt. police arrested the man. they later learned he had a warrant for a burglary in contra costa. san francisco police are warning members of the china community about a scam targeting older victims. they want everybody to take a close look at this video. it shows three people targeting a victim in this scam. police say that the conartists trick people into seeing a doctor who will bless their valuables. they are then put in a bag, conartists switch out the valuables for objects of similar weight during the blessing. >> a car fire forced the evacuation of an apartment building. it half just before midnight. the car was parked in a carport when it caught fire.

investigators aren't commenting but tenants believe it was set on purpose because there were two separate fire its, one in the front and the other in the trunk. >> yes. it looks suspicious, especially -- and you know really scare us because we have people, we have families over here and kind of difficult for us. >> there were no injuries, firefighters kept the flames spreading upstairs. >> human flames a building fire in massachusetts but it was the freezing conditions that were more challenging. spray from their fire hoses actually formed ice and made for slippery conditions on the ground. ice formed on their helmets and jackets while they tried to fight the fire and the cause of the fire is under investigation. a new strain of virus is spreading here in the united states. the cdc said that the virus strain from australia has caused 140 outbreaks here. the strain is already hit japan and western europe.

sweetwater music hall. the concert starts at nine. it'll benefit the medical care fund. he was hurt in an attack at dodger stadium in 2011. mike parsons is recovering a broken neck he got surfing off ocean beach. he nearly drowned after hitting his head into the water while trying to catch a wave. he was wearing a flotation device which he says saved his life. he is expected to make a full recovery. >> it's a sound of cheering for gay couples in rhode island. the rhode island house passed legislation that would allow same sex marriage but it's not official just yet. it has to go through the senate. rhode island is the only state in new england doesn't allow it. the facebook founder wants to help his friend stay a governor.

. welcome back. the investigation into the boeing dream liner is far from complete. that's according to safety regulators. the chair says investigators have found symptoms in the battery fire of a jet in boston. she adds they have not yet found the cause of the problem. she calls the safety problems an unprecedented event. the dream liner has been grounded around the world since last week. people who work at restaurants in san francisco get another payday. more than 50 owners beg targeted for charging extra fees to cover the health care coverage. the city claims only a third of the money went to medical costs. today san francisco city attorney plans to announce a
